Leading Appellate Lawyer Yaira Dubin Joins Sullivan & Cromwell From Solicitor General’s Office

NEW YORK (SEPTEMBER 3, 2025) - Sullivan & Cromwell LLP announced today that Yaira Dubin has joined the firm as a partner in its New York office. Ms. Dubin joins S&C from the U.S. Department of Justice's Office of the Solicitor General. As an Assistant to the Solicitor General from 2021 to 2025, Ms. Dubin represented the United States in matters before the Supreme Court, supervised priority litigation in federal appellate and district courts, and advised agencies across the federal government. Now returning to private practice, Ms. Dubin will strengthen S&C's litigation capabilities and expand the footprint of the firm's leading Supreme Court and Appellate Practice in New York.

Ms. Dubin has won major copyright, bankruptcy, tax, labor and employment, constitutional, and civil rights appeals. She has argued six cases in the U.S. Supreme Court, including Cunningham v. Cornell University (ERISA); United States v. Miller (bankruptcy); Connelly v. United States (tax); Warner Chappell Music v. Nealy (copyright damages); Santos-Zacaria v. Garland (jurisdiction); and Andy Warhol Foundation v. Goldsmith (copyright fair use). While at the Solicitor General's Office, Ms. Dubin also filed over 100 Supreme Court briefs at the merits and certiorari stages, involving diverse areas of federal law such as securities regulation, federal contracting, intellectual property, criminal procedure, sovereign immunity, the Medicare Act, the First Amendment, and reproductive rights. During her previous tenure in private practice, Ms. Dubin successfully litigated on behalf of her clients in federal and state appellate courts across the country. Outside the courtroom, Ms. Dubin counsels clients on legal and strategic objectives, including clients at the cutting edge of innovation navigating novel regulatory questions.

Ms. Dubin earned her J.D., magna cum laude, from Harvard Law School and her bachelor's degree in Biology, summa cum laude, from Yeshiva University. She clerked at all three levels of the federal judiciary: for Justice Elena Kagan on the U.S. Supreme Court, Judge Sri Srinivasan on the U.S. Court of Appeals for the D.C. Circuit, and Judge James E. Boasberg on the U.S. District Court for the District of Columbia.

  • Allianz SE, obtaining a Ninth Circuit ruling affirming the dismissal with prejudice of all claims brought against the company and a U.S. subsidiary by a putative class of ADR holders that sued after the collapse of the Structured Alpha Funds.
  • Canadian Pacific, winning a pair of multibillion-dollar appeals: one rejecting a challenge to the company's $31 billion merger with Kansas City Southern, and another affirming the dismissal of a bondholder redemption suit.
  • JPMorgan, winning the unanimous dismissal of all state securities and common law claims on appeal to the Second Circuit in connection with a syndicated loan arranged by a group of banks.
  • Bayer, prevailing in an appeal before the en banc Delaware Supreme Court in a multibillion-dollar case involving liability for consumer talc product claims.
  • Major League Baseball, successfully defending it in a high-profile appeal alleging that MLB's minor league player development system reorganization in 2020 violated the federal antitrust laws.
