The Association of California Water Agencies (ACWA) respectfully submits comments regarding the U.S. Environmental Protection Agency's (EPA) and U.S. Army Corps of Engineers (USACE) (collectively "the agencies") supplemental notice of proposed rulemaking regarding an updated definition of "waters of the United States" (WOTUS). ACWA has concerns with the agencies' supplemental proposal as discussed below and urges the agencies to develop a clear, durable definition of WOTUS to meet the nation's water supply and quality needs.
