During the lapse in appropriations, the Commission will adjudicate only those Federal Mine Safety and Health Act of 1977 disputes that arise from a mine emergency, or where there is a reasonable likelihood that the safety of life or the protection of property would be significantly compromised if prompt adjudication is not provided.

All other agency operations, including hearings before an Administrative Law Judge and decisional meetings of the Review Commission, will be suspended during the lapse.
If the government shuts down five or fewer business days before a scheduled hearing or decisional meeting, the event will be deemed cancelled, even if the government subsequently reopens before the scheduled date.
Upon reopening, the Commission will reschedule hearings and decisional meetings and address any filings on a case-by-case basis.
