Rep. Roy Introduces Bill to End Taxpayer Funded Housing Benefits for Illegal Aliens

Washington, D.C. - Today, Congressman Roy (R-TX) introduced The No Housing Welfare for Illegal Aliens Act, legislation that would ban sanctuary jurisdictions from receiving federal housing grants and end housing benefits from going to illegal alien households.

"For too long, hardworking Americans have been forced to watch their tax dollars bankroll benefits for individuals who broke our laws to enter this country. The No Housing Welfare for Illegal Aliens Act puts Americans first by ending housing subsidies for illegal aliens, shutting down loopholes for mixed-status households, and cutting off federal grants to sanctuary cities that defy federal immigration enforcement. Federal housing assistance should go to American citizens-not reward immigration lawbreakers and subversive localities," said Rep. Roy.

The No Housing Welfare for Illegal Aliens Act would do the following:

  • Sanctuary City Grant Ban: Statutorily prohibits the Secretary of Housing and Urban Development (HUD) from issuing grant funding under the CDBG or HOME programs to states, localities, or tribal governments that provide housing assistance to illegal aliens or undermine federal law by acting as a sanctuary jurisdiction. Additionally, this bill prevents those same states, localities, and tribes from dispersing the CDBG, HOME, or their own grant funding to third-party entities that provide assistance to illegal aliens, closing a critical loophole in eliminating welfare for illegal aliens.
  • Codifying Mixed-Status Rule: Amend the federal code to remove all authorizations for the prorating of housing benefit assistance to households in which residents have not been verified as eligible, explicitly prohibit the prorating of benefits to households with unverified eligibility, and require the withholding of all housing benefit assistance until all members of a household have been verified as eligible.

Background:

During President Trump's first term, HUD issued a rule to end the indefinite prorating of housing assistance to 'mixed-status' households, but President Biden's HUD quickly withdrew that rule. Under the second Trump administration, HUD reissued the rule. Rep. Roy's bill would codify the policy to prevent a future recalcitrant HUD from giving taxpayer dollars to illegal alien households.
