U.S. Department of Agriculture (USDA) Award Terms and Conditions

The U.S. Department of Agriculture (USDA) has implemented new award terms and conditions that prohibit recipients from entering into contracts, subawards, purchase orders, or other procurement agreements with any individual or entity that is subject to foreign ownership, control, or influence by a Foreign Country of Concern (FCOC), as defined by the U.S. Department of Commerce (15 CFR § 791.4).

Departments receiving or administering USDA-funded awards must ensure that all procurement activities comply with these requirements. Prior to engaging a supplier or issuing a procurement action under a USDA-funded project, departments should consult with Procurement Services to verify supplier eligibility and ensure compliance with all applicable federal award conditions.
