Announcing Pregnancy, McIver Speaks to Hope and Continued Fight to Protect

WASHINGTON, D.C. - Today, Congresswoman LaMonica McIver (NJ-10) announced that she is expecting her second child. She released the following statement:

"I am so excited to be welcoming a new baby to our family this fall. This moment is filled with so much joy for my family and me. Being a mom is one of the greatest joys of my life, and I am grateful that my family is growing," said McIver. She continued, addressing the Trump DOJ's ongoing case against her, "I have been clear that this case will not keep me from doing my job, and it will not keep me from living my life. I will keep fighting against this administration's cruel agenda and for a better world-that's what moms do for our babies, and it is what I have always done for my community."

McIver already has one nine-year-old daughter. McIver is one of a small group of women serving in Congress with school-aged children and will be one of only a small handful who have given birth while holding congressional office. She has shared her reproductive health journey in the past, including her rush from a uterine fibroid removal surgery in New Jersey to make a vote in Washington, D.C., to protect healthcare for Americans.

McIver has repeatedly called for oversight of ICE and DHS, which have separated children and families and abused detainees. In a January profile in The New Yorker, she spoke about those abuses: "McIver's fiery, sometimes combative public persona was gone; in its place was the heavy-lidded look of someone overwhelmed by what she'd just witnessed. 'The one thing, in addition to sadness and depression and disappointment, was the whole idea that all of these people were Black and brown,' she said. [...] She met a family from Toms River, New Jersey-a mother, son, and daughter who'd been living in the U.S. for twelve years when they were arrested by ICE."

In April, McIver and counsel filed a brief with the Third Circuit Court of Appeals in U.S. v. McIver arguing that the Trump Department of Justice cannot prosecute her for doing her job, nor can it selectively prosecute her because of her opposition to the administration's mass deportation agenda. The government has now replied to that brief. McIver is appealing the decisions by the district court, declining to dismiss the case that was filed against her by then-interim U.S. Attorney, and Donald Trump's former personal lawyer, Alina Habba. McIver's next court appearance will be in relation to this appeal. Oral arguments before the Third Circuit Court of Appeals are slated for June 23, 2026.
