The Division of Workers' Compensation (DWC) has issued a Notice of Public Hearing regarding a proposed evidence-based update to the Medical Treatment Utilization Schedule (MTUS), including a proposed amendment to California Code of Regulations, title 8, to section 9792.23.6.
The proposed update would incorporate by reference the latest guideline published by the American College of Occupational and Environmental Medicine (ACOEM):

Members of the public are invited to review and comment on the proposed update. Written comments must be submitted by Friday, October 16, 2026. Instructions for submitting comments are posted on DWC's proposed regulations page.
The proposed evidence-based update to the MTUS regulations is exempt from Labor Code sections 5307.3 and 5307.4 and the rulemaking requirements of the Administrative Procedure Act. However, under Labor Code section 5307.27, DWC must provide a 30-day public comment period, hold a public hearing and respond to all comments received before publishing the order adopting the update online.
The California Department of Industrial Relations' Division of Workers' Compensation monitors the administration of workers' compensation claims and provides administrative and judicial services to help resolve disputes related to claims for workers' compensation benefits.
