On remand from Shell Energy N.A. (US), L.P. v. FERC, 107 F.4th 981 (D.C. Cir. 2024), the order reverses the Commission's previous decision to order Brookfield Renewable Trading and Marketing LP (Brookfield) to pay refunds for spot market energy sales that exceeded the Western Electricity Coordinating Council soft price cap of $1,000/MWh. The order finds that Brookfield is entitled to recoupment of the refunds already paid and directs the refund recipients to provide recoupment to Brookfield.

ORDER GRANTING COMPLAINT IN PART AND DENYING IN PART

The order grants the complaint, in part, finding that the ISO-NE's failure to cap the Balancing Ratio at 1.0 under its existing Forward Capacity Market rules is unjust and unreasonable because, in the absence of such a cap, resources with Capacity Supply Obligations in ISO-NE may be subject to financial charges even when they are providing their maximum possible physical output during Capacity Scarcity Conditions. The order denies the complaint with regard to the ISO-NE tariff's allocation methodology for the stop-loss mechanism, finding that NEPGA has failed to demonstrate that this methodology is unjust, unreasonable, or unduly discriminatory or preferential.
