Federal Judge Dismisses Water Pollution Suit Over Lack of Standing

On Sept. 8, 2025, a federal judge in Minnesota dismissed an $18 million environmental lawsuit by Citizens for a Clean Environment (CCE) against Taft's client, Aitkin Agri-Peat, Inc. (AAPI), finding that the group lacked standing to sue over alleged improper wastewater discharges from a peat mine. The court ruled CCE's members did not show personal harm, as their claims focused only on lessened recreational enjoyment rather than direct impact. All other motions, including requests for sanctions, were denied, ending the case without prejudice. This dismissal order came nearly seven months after the initial hearing, and after numerous motions by the plaintiff.

The Taft Minneapolis team included partner Jack Perry and associates Bray Smith and Trish Palermo.
