Erie County District Attorney Michael J. Keane announces that Shannon O. Rose, 19, of Sloan, was sentenced yesterday morning before State Supreme Court Justice Kelly Vacco. He received a determinate sentence of 364 days in jail.
On the morning of Sunday, July 20, 2025, the defendant discharged a firearm through a door during a domestic incident involving another person inside of a residence on the 100 block of Lackawanna Avenue in the Village of Sloan. After traveling through the door, the bullet ricocheted and subsequently injured a toddler in another room. The victim, a 2-year-old male child, was taken by ambulance to Oishei Children's Hospital. The child continues to recover from the injury. The investigation determined that the defendant fired the weapon in self-defense.
Rose pleaded guilty to one count of Criminal Possession of a Firearm (Class E felony), the only sustainable charge, on August 28, 2025.
Marcus Oluwa, Jr., 20, of no permanent address, was indicted on one count of Criminal Possession of a Weapon in the Second Degree (Class C violent felony) and one count of Criminal Possession of a Weapon in the Third Degree (Class D felony). During the investigation into the non-fatal shooting in the Village of Sloan, the defendant was allegedly found in possession of a loaded, illegal gun equipped with a large capacity magazine at a location in the City of Buffalo.
Oluwa is scheduled to return before Erie County Court Judge Kenneth Case on Friday, October 24, 2025, at 9:30 a.m. for a pre-trial conference. He remains held on bail set at $100,000 cash or bond. If convicted of the highest charge, Oluwa faces a maximum sentence of 15 years in prison.
DA Keane commends the Cheektowaga Police Department, Buffalo Police Department and New York State Police for their work in this investigation.
The case against Rose was prosecuted by Chief Ashley M. Morgan of the Major Crimes Bureau. The case against Oluwa is being prosecuted by Assistant District Attorney Briana R.D. Kalman of the Major Crime Bureau.
As are all persons accused of a crime, the defendants are presumed innocent until proven guilty in a court of law.
