We are grateful to Senator Jon Husted for proposing Amendment #1 to S. 2658, which narrows the bill's new patent infringement defense to cases involving material conduct that directly affects patentability. We appreciate the Senator's reasonable and common-sense proposal, which would reduce administrative burdens related to research efforts, ensuring that precious resources are spent in the lab, not on unnecessary legal fees. Senator Husted's amendment provides greater certainty for our hospitals, while preserving safeguards against misconduct, and represents a thoughtful step toward achieving this important balance."
