They looked at recent cases and how litigation before the EU's Court of Justice is evolving. They identified gaps for joint advocacy and discussed a Charter-based litigation hub. The key role of strategic litigation to advance and progress on the implementation and application of the Charter in the current legal and political scenario in the EU was highlighted by the participants, from a variety of civil society organisations working on a variety of themes.
The UN Refugee Agency and the European Commission also attended the meeting.
Strategies to improve strategic litigation discussed included the possibility to develop 'Amicus Curiae' or at least 'Third Party interventions' - also at the level of the Court of Justice - and exploring possibilities for funding, including from the EU, for strategic litigation more generally.
FRA presented its own activities which can support strategic litigation, signalling also new possibilities which could emerge following the recent publication of the mid-term review of the current strategy to strengthen the application of Charter.
