The New York Workers' Compensation Board (Board) has updated its Notice of Objection to a Payment of a Bill for Treatment Provided (Form C-8.1B) to require payers to provide a detailed explanation of their objections to bills for medical treatment. The form's certification statement has also been amended to indicate that copies of the form were sent to all those required by law. The changes apply to both the paper and online versions of the form.
Detailed explanations required
Within Section C of Form C-8.1B, Objection Reasons - Legal and Medical Treatment Guidelines:
The information entered in these fields must provide clear and detailed narrative explanations of the objections raised by the payer and include relevant facts, such as dates and injury sites, when appropriate. Failure to provide a detailed explanation in boxes 12 and/or 20 may result in the C-8.1B form being deemed incomplete and denied.
Certification statement amended
Additionally, the certification portion of Form C-8.1B has been updated to align with 12 NYCRR 325-1.25(c)(1). This regulation requires the employer or insurance carrier (or its third-party administrator) to notify the medical provider, the claimant, the claimant's attorney (if applicable), and the Board when a bill for treatment is not being paid and the reasons for non-payment. The prior version of the form only asked the preparer to certify that a copy of the form was sent to the health provider. On the revised form, the certification has been amended to indicate that a copy of the C-8.1B form was also sent to the claimant, the claimant's attorney (if applicable), and the Board.
New form mandatory on January 5, 2026
The updated paper version of Form C-8.1B is available on the Forms page of the Board's website as of today. Use of the updated form will be mandatory effective January 5, 2026. Older versions of Form C-8.1B will not be accepted after January 5, 2026. To avoid delays, please ensure you are using the updated form. The online version of the form will be updated soon.
