Officers from Tempe's Criminal Apprehension Surveillance Team, with support from the U.S. Marshals Service, took Kathleen Tierney into custody in Tucson.
Tierney faces one count of Computer Tampering (ARS 13-2316A5), a Class 5 felony,which under the statute involves "recklessly using a computer, computer system or network to engage in a scheme or course of conduct that is directed at another person and that seriously alarms, torments, threatens or terrorizes the person." In addition, Tierney faces two counts of Disorderly Conduct (ARS 13-2904), both Class 1 misdemeanors.
On Aug. 28, Tierney's post created an immediate safety concern that caused officers to shut down the council meeting and clear the chambers of all community members, city staff, and elected officials. The meeting was cancelled out of an abundance of caution and rescheduled. The next two meetings were held virtually.
"This arrest demonstrates our unwavering commitment to protecting the safety of our community members and elected leaders. Threats like this not only endanger lives, they disrupt civic engagement and silence the voices of the people we serve. We will not allow intimidation to interfere with democracy in our city," said Tempe Police Chief Ken McCoy.
The Tempe Police Department and the City of Tempe remain committed to protecting the safety and security of everyone who lives, works, and participates in public service within the city. Officers treat every threat seriously, investigate thoroughly, and take decisive action to hold offenders accountable.
The investigation remains active, and no additional details are available for release at this time.
