Ewing was sentenced to a combination of jail time and work release to be followed by probation. After Ewing absconded from work release, the State filed a motion to revoke his community corrections placement but did not file a petition to revoke his probation sentence. The Vanderburgh Circuit Court revoked Ewing's community corrections placement and ordered him to serve his remaining sentence in the Department of Correction. The Court of Appeals affirmed. Ewing v. State, 252 N.E.3d 449 (Ind. Ct. App. 2025), trans. pending. Ewing petitioned the Indiana Supreme Court to assume jurisdiction over the appeal.
