At its June 3, 2026 meeting, the Indio City Council unanimously approved an urgency ordinance establishing a 45-day moratorium on new data center development applications within the city.

What is an urgency ordinance?
An urgency ordinance is a legislative tool that allows a city council to take immediate action on a matter that requires prompt attention. Under state law, an urgency ordinance requires a two-thirds vote of the City Council for approval. For the Indio City Council, that means at least four affirmative votes.
Are there any data center applications currently submitted in Indio?
No. There are currently no active applications for data center projects within the City of Indio.
Why was the moratorium adopted and what happens next?
The moratorium will provide staff with time to further study the issue and engage in a public review process and land use analysis required by state law. Staff is scheduled to present information and policy options to the Planning Commission on June 24, followed by a discussion with the City Council on July 15.
As part of that process, the City will evaluate potential next steps, which may include developing very strict regulations for data centers, extending the moratorium, or considering a permanent prohibition on data center uses within the city.
