COLUMBUS -State Representatives D.J. Swearingen (R-Huron) and Tex Fischer (R-Boardman) are pleased to announce that Ohio Governor Mike DeWine last week signed House Bill 246, the E-Verify Workforce Integrity Act, into law.
Once effective, the law will ensure that all workers hired for covered construction projects in Ohio are legally authorized to work in the United States.
All contractors, subcontractors, and labor brokers working on public works projects for state agencies and political subdivisions and private-sector contractors in nonresidential construction will be required to use the federal E-Verify program to confirm employee eligibility. The program streamlines verification of new employees' work permits, visas, and citizenship within 3-5 seconds.
"This act is a great step in stopping illegals ripping off hardworking Ohioans," said Swearingen. "Ohio's opportunities belong to Ohio's families."
"Ohio jobs should be for Ohio workers," said Fischer. "The E-Verify Workforce Integrity Act is a huge step towards protecting our workers from illegal immigrants who can undercut wages and pose safety risks. I'm grateful the governor signed this bill, after passage with unanimous bipartisan support in both chambers."
Additionally, the law will establish proper oversight by granting the Attorney General the authority to investigate suspected violations, issue notices of violation, and pursue enforcement through the courts if necessary.
The E-Verify Workforce Integrity Act will become effective on March 19, 2026.
