Bismarck, ND - Attorney General Drew H. Wrigley today issued an urgent advisory, warning North Dakota residents to be aware of companies offering stem cell treatments and other human tissue injections through sales presentations at local restaurants. The companies make unproven claims that their therapies can relieve pain and can cure, treat, or mitigate a wide range of health conditions, including Parkinson's disease, diabetes, multiple sclerosis, orthopedic problems, Alzheimer's disease, autism, and dementia. These promotional activities are false and misleading and pose a serious threat of physical and financial harm to North Dakotans.

It is unlawful under state and federal law to sell these treatments without rigorous clinical testing and subsequent approval by the Food and Drug Administration's (FDA). Although some of these companies claim they use FDA-registered facilities or comply with FDA guidelines, this does not mean that they have FDA approval for the marketed treatments or that they follow federal requirements for safely producing and marketing the treatments. The FDA has taken enforcement actions against companies marketing stem cell products without approval and warned that they risk patients' safety. Additionally, the Federal Trade Commission found similar sales presentations and claims about stem cell therapies to be an unfair and deceptive act that violated federal law and injured consumers. Reported harms from the injection of unapproved stem cell products include life-threatening infections, chronic pain, and other problems.

One of these companies, Freedom Regenerative LLC, sends mailers to North Dakota residents inviting them to a free dinner event where the company delivers sales presentations that include false and misleading promises of pain reduction or otherwise overstate the efficacy of the products offered. Freedom Regenerative LLC conducted business in North Dakota without a transient merchant license mandated by North Dakota law. The cost of the company's offered treatments ranges between $9,000 and $29,000.

"There is a cause for alarm, because these unproven products or therapies pose a significant risk to an individual's health and financial well-being," said Wrigley. "Businesses that make unsubstantiated claims and violate the law will be held accountable, particularly when they target older adults and take advantage of a person's pain or illness for their own gain," adds Wrigley.

Wrigley urges all consumers to consult with their primary physician before agreeing to purchase alternative medical treatments advertised online or pitched though local sales presentations.

Anyone with questions or who believes they purchased stem cell treatment under misleading or inaccurate representations may file a complaint with the Attorney General's Consumer Protection and Antitrust Division at www.attorneygeneral.nd.gov or call 701-328-3404.

The Attorney General's Consumer Protection and Antitrust Division is dedicated to protecting North Dakota residents from misleading, deceptive, or unlawful practices in connection with the sale or advertisement of goods or services by enforcing the state's antitrust and consumer protection laws.
