CDS/DM Message: Bill C-11, the Military Justice System Modernization Act, receives Royal Assent

Bill C-11, the Military Justice System Modernization Act, has now received Royal Assent. This important milestone reflects our commitment to modernizing the military justice system to ensure that it remains fair, effective, and aligned with the values we uphold as members of the Defence Team.

This legislation introduces measured and necessary reforms to the National Defence Act. It implements key recommendations from the Third Independent Review of the National Defence Act and responds to Recommendation 5 from the Report of the Independent External Comprehensive Review of the Department of National Defence and the Canadian Armed Forces (IECR).These changes strengthen a system that must remain credible, responsive, and grounded in the highest legal and ethical standards.

A key reform removes Canadian Armed Forces (CAF) investigative and prosecutorial jurisdiction over Criminal Code sexual offences committed in Canada, while retaining jurisdiction outside of Canada. This change is intended to simplify processes for victims, reduce confusion caused by overlapping systems, and provide greater independence from the chain of command in sensitive cases. It marks a deliberate step in the continued evolution of the military justice system to strengthen clarity, confidence, and trust.

Bill C-11 also expands access to Victim's Liaison Officers under the Declaration of Victims Rights. Additionally, it removes military judges from the summary hearing system and aligns sex offender information and publication bans with amendments made to the Criminal Code.

As we move forward, implementation will be thoughtful and deliberate, alongside continued efforts to strengthen culture, improve conduct, and enhance support for all Defence Team members.
