WASHINGTON - House Education and Workforce Committee Ranking Member Robert C. "Bobby" Scott (VA-03) issued the following statement after the Supreme Court declined to hear former National Labor Relations Board (NLRB) Member Gwynne Wilcox's appeal, thus upholding President Trump's unprecedented decision to fire her in January 2025 and further undermining the agency's independence.
"The decision to let stand the unprecedented firing of Ms. Wilcox, as with the Supreme Court's posture to undercut the independence of the Equal Employment Opportunity Commission (EEOC), makes it clear to all that the right-wing majority in the Supreme Court has once again put the interests of President Trump and big corporations ahead of working Americans.
"It should not go unnoticed that in June, the Supreme Court decided to block Trump from firing Federal Reserve Board of Governors Member Lisa Cook because he failed to provide sufficient 'due process' to justify her removal. Reasonable minds can deduce that the Supreme Court chose to acknowledge the independence of an agency that acts to protect the interests of the investor class, but incoherently reached a different conclusion regarding the agencies that are responsible for protecting the rights of workers."
Background: On February 13, 2025, Ranking Member Scott, House Committee on the Judiciary Ranking Member Jamie Raskin, and House Committee on Oversight and Government Reform Late-Ranking Member Gerald E. Connolly demanded President Trump reverse his firing of National Labor Relations Board (NLRB) Member Gwynne Wilcox and provide information related to the decision to violate federal law.
On April 10, 2025, Ranking Member Scott, along with House and Senate Democratic leaders, filed an amicus brief opposing President Donald Trump's attempts to fire members of the NLRB and the Merit Systems Protection Board.
