The Centers for Medicare & Medicaid Services (CMS) published a checklist for states to implement Section 71109 of the Working Families Tax Cut legislation (WFTCL). This law limits Medicaid eligibility to U.S. citizens and nationals, lawful permanent residents, Cuban/Haitian entrants, and Compacts of Free Association migrants.
Beginning Oct. 1, asylees, refugees, parolees, or victims of human trafficking will be ineligible for nonemergency Medicaid, unless their state has elected the CHIP Reauthorization Act 214 option and they meet the criteria. To implement these changes, CMS created a checklist for system and operational changes for states to employ to maintain compliance with the WFTCL. The checklist provides detailed steps to:
