Grimm Krupa Introduces Legislation to Ensure Pennsylvania Farmers, Truckers Can Take Full Advantage of Federal Diesel Relief

HARRISBURG - State Rep. Charity Grimm Krupa (R-Fayette) today announced the filing of a co-sponsorship memorandum for legislation that would ensure Pennsylvania takes the necessary action to maximize newly available federal diesel relief for the Commonwealth's farmers, truckers, small businesses and other diesel users.

The announcement comes just days after President Donald Trump signed an executive order temporarily allowing the highway use of dyed diesel and directing the federal government to defer certain federal diesel fuel tax obligations through the end of 2026. The federal diesel tax is currently 24.4 cents per gallon.

"Pennsylvania should not be the reason federal relief stops at our state line," said Grimm Krupa. "President Trump has taken action to help the farmers and truckers who keep our economy moving. Now Pennsylvania needs to make sure our laws allow Pennsylvanians to take full advantage of that relief."

Krupa's proposed legislation would amend Pennsylvania law to expressly permit the use of dyed diesel fuel on Pennsylvania public highways whenever that use is authorized under federal law or an executive order issued by the president, for the duration of the federal authorization. The legislation would also direct the Pennsylvania Department of Revenue to establish an alternative notice requirement for periods when dyed diesel is legally permitted for highway use and provide protections for fuel sellers who sell or deliver dyed diesel for highway use when that use is federally authorized.

"A farmer cannot wait for government to figure this out," Grimm Krupa said. "Diesel isn't a luxury for Pennsylvania's farmers and truckers. It is a necessity. A farmer cannot harvest a crop without diesel. A trucker cannot move Pennsylvania's products without diesel. A contractor cannot operate heavy equipment without diesel. And our economy cannot function without the people who depend on it."

The White House has specifically called on states to take corresponding action following the president's executive order. The order directs federal officials to engage with state governments and encourages states to adopt policies corresponding with the federal relief.

Grimm Krupa said her legislation is intended to provide clarity and ensure Pennsylvania law keeps pace with the federal action.

"This is about common sense," Grimm Krupa said. "Our farmers are facing rising input costs. Our truckers are facing rising operating costs. Our small businesses are facing rising transportation costs. Every dollar matters."

The president's order directs Treasury to determine the specific federal relief available and issue implementing guidance, while also directing the federal government to encourage corresponding state action.

"If the federal government provides an avenue for relief, Pennsylvania should do everything within its authority to make that relief available to Pennsylvanians," Grimm Krupa said. "I am asking my colleagues to join me in making sure that federal diesel relief actually reaches the people who need it most."
