Case Processing Updates for Chapter 11, Chapter 12, and Chapter 13 Cases

The Bankruptcy Court has implemented the following changes that impact Chapter 11, Chapter 12, and Chapter 13 cases.

  • After a Chapter 11, Chapter 12, or Chapter 13 case converts to Chapter 7, the Court will automatically issue a Post-Conversion Order. This new order establishes deadlines to comply with Federal Rule of Bankruptcy Procedure 1019 requirements, including the deadline to file the Schedule of Unpaid Postpetition, Preconversion Debts, the Final Report Upon Conversion of Chapter 11 or Chapter 12 Case to Chapter 7 (Chapter 11 and Chapter 12 cases only), and to request payment of an administrative expense under 11 U.S.C. § 503. With these changes, the Court is providing one new form and one updated form in its "Other Local Forms" menu: Schedule of Unpaid Postpetition, Preconversion Debts and Final Report Upon Conversion of Chapter 11 or 12 Case to Chapter 7.
  • The Court has removed its Chapter 11 Ballot form from the "Other Local Forms" menu. Applicable orders entered in Chapter 11 cases will instruct Chapter 11 plan proponents to use Official Form 314 to prepare ballot forms. With this change, ballots will be delivered to the plan proponent, and the plan proponent will be instructed to file all ballots in accordance with the Clerk's procedures.
