Fischer Applauds E15 Waiver, Calls for Permanent Solution

WASHINGTON - Today, U.S. Senator Deb Fischer (R-NE) released the following statement after the Environmental Protection Agency (EPA) issued an emergency waiver to allow the sale of E15 gasoline during the summer season:

"I thank EPA Administrator Zeldin and the Trump administration for issuing another emergency waiver for E15 to be sold year-round across the country. This will undoubtedly bring some short-term relief to our farmers and ranchers, and ease fuels costs on Americans. The fact remains that this is not a long-term solution, and it is far past time for Congress to make this permanent. My Nationwide Consumer and Fuel Retailers Choice Act gets it done, and I am working to end the need for these emergency waivers and give consumers the year-round flexibility choice they deserve."

Background

Fischer has been a staunch advocate for the year-round sale of E15 since 2015, when she first co-led a bill to allow year-round E15 during the 114th Congress.

In 2017, she introduced the Consumer and Fuel Retailer Choice Act to amend the Clean Air Act and allow the year-round sale of E15.

In 2019, Fischer traveled with President Trump to Nebraska and Iowa when he announced regulatory efforts to allow the year-round sale of E15. When President Trump's efforts were struck down by courts, Fischer continued to lead by reintroducing her legislation in 2021, during the 117th Congress. Fischer released an updated bill in 2022 with substantial support.

In 2023, Fischer introduced the Nationwide Consumer and Fuel Retailer Choice Act of 2023, and Rep. Adrian Smith (NE-03) introduced companion legislation in the U.S. House of Representatives.

On the first day of his second term, President Trump took steps to make E15 available year-round through his Executive Order Declaring a National Energy Emergency.

In February of 2025, Fischer reintroduced her Nationwide Consumer and Fuel Retailer Choice Act of 2025 to allow the year-round sale of E15 and codify President Trump's executive order.
