With federal courts overturning the Biden administration's Retirement Security Rule, opponents support reverting to ERISA standards that largely limit fiduciary duty to ongoing advice, a change Erin Koeppel, Managing Director for Government Relations and Public Policy at CFP Board, says leaves a significant regulatory gap. CFP Board has enforced fiduciary rules since June 2020 requiring its more than 107,000 CFP® professionals across all industry channels to adhere to a fiduciary duty for every type of advice.
