BNC Disruption and Bankruptcy Rules Emergency

Monday, October 26, 2026

On October 26, 2026, Chief Judge Holt entered on behalf of the Bankruptcy Court, Administrative Order No. 2026-05, facilitating application of the "Bankruptcy Rules emergency" under Rule 9038 of the Federal Rules of Bankruptcy Procedure, as declared by the Executive Committee of the Judicial Conference on October 22, 2026. The emergency declaration is based on a finding that extraordinary circumstances affecting electronic access to the bankruptcy courts substantially impair the courts' ability to perform their functions in compliance with the Bankruptcy Rules due to the ongoing nationwide disruption of services provided by the Bankruptcy Noticing Center (BNC).

For additional information, including provisions of the order, please review Administrative Order No. 2026-05.
