State to Publish New Construction Contracts

The Ohio Facilities Construction Commission (OFCC) is pleased to announce the publication of new State of Ohio facility construction contracts.

On October 30, 2025, these future contracts for Construction Manager at Risk (CMR), Design Build (DB) and General Contracting (GC) will be published on OFCC's public website. All of these new documents will be effective and available for use on January 1, 2026. Redlined versions noting all changes will also be available on OFCC's website.

We encourage everyone to learn and understand the changes to the State of Ohio's standard design and construction contracts prior to them being effective on January 1, 2026.

There are Supplemental Conditions published on OFCC's website for each delivery method to address the law changes from Amended Substitute House Bill 96 (Am. H.B. 96) that went into effect September 30, 2025. These Supplemental Conditions should be used in conjunction with the current set of agreements for any new projects/contracts starting before January 1, 2026.

The OFCC will be publishing Multiple Prime and Limited Scope GC contracts in December 2025 that replicate the changes made in the documents for the delivery types referenced above. These documents will also be effective and available for use on January 1, 2026.
