As Senate Republicans Move to Give ICE, CBP Up to $140 Billion, Data Emerges Showing the Agencies Sitting on Over $100 Billion from Previous Reconciliation Bill

$103 Billion in Funding for ICE, CBP Remains Unobligated as of March

WASHINGTON, D.C. - As Senate Republicans prepare to vote on a budget resolution that dictates giving Immigration and Customs Enforcement (ICE) and Customs and Border Protection (CBP) up to $140 billion in new funding, data from the Office of Management and Budget's (OMB) SF-133 reports shows that as of the end of March, the two agencies are sitting on more than $103 billion in unobligated funding from the One, Big Beautiful Bill Act (OBBBA) that passed last July. Following this news, U.S. Senator Jeff Merkley (D-OR), Ranking Member of the Senate Budget Committee, released the following statement.

"As the American people beg Congress to focus on lowering the cost of gas or to make their weekly groceries more affordable, Republicans are choosing to ignore them. While ICE and CBP sit on over $100 billion that they received in the Republican Big, Ugly Betrayal Bill last summer, Republicans are now moving to throw upwards of $140 billion more at these agencies rather than work to bring down costs for working families. And as Republicans claim that they plan to only spend about $70 billion for this bill, every penny could be better spent elsewhere - like paying more than 250,000 teachers for four years," said Ranking Member Jeff Merkley. "Republicans are championing a vision of our country with lawless federal agents, where families lose and billionaires win. As Ranking Member of the Senate Budget Committee, I will fight further unchecked power and blank checks to Trump's secret police and continue to focus on hardworking families."

Using publicly available data published monthly by OMB, Senate Budget Committee staff calculated how much funding for ICE and CBP remain unobligated from OBBBA.

As of the end of March 2026:

  • Of the $74.9 billion provided to ICE in OBBBA, $63.2 billion remain.
  • Of the $64.7 billion provided to CBP in OBBBA, $40.0 billion remain.

Budget Committee staff examined apportionment amounts from the SF-132, or Apportionment and Reapportionment Schedule via OpenOMB.org to determine which Treasury Account Fund Symbol (TAFS) received money from OBBBA, P.L. 119-21. Staff then used OMB's monthly SF-133 reports to determine the mandatory unobligated balances for each account, identified by TAFS numbers. The SF-133, or Report on Budget Execution and Budgetary Resources, shows how much budget authority an agency has, how much has been obligated and expended, and what remains available in each account designated by TAFS numbers.
