The Broker-Lawyer Committee (BLC) met July 10, 2026, to continue reviewing Texas real estate contract forms, consider public comments, and discuss potential future contract updates. Here are some of the highlights.
The committee received several comments and questions on the new Seller's Disclosure About Groundwater and Surface Rights. The committee discussed reviewing the following topics at future meetings:
The committee also discussed educational resources needed to help license holders understand the new disclosure.
Among the topics discussed was Paragraph 7 of the Amendment form, which addresses the additional option period. The BLC reviewed language related to additional option fees and agreed to continue evaluating possible revisions.
The committee considered revisions to Paragraph 7A, Access, Inspections and Utilities, of the contract forms, to clarify who may access the property and when they may do so. The current working draft would provide that after the buyer has paid any required option fee and earnest money, the seller must allow reasonable property access and specifically authorizes buyers and their inspectors to conduct a final walkthrough at a reasonable time before closing to review completed repairs or determine the property's condition.
