EEOC Votes to Rescind Enforcement Guidance on Arrest and Conviction Records

WASHINGTON - The U.S. Equal Employment Opportunity Commission (EEOC) voted yesterday to rescind its Enforcement Guidance on the Consideration of Arrest and Conviction Records in Employment Decisions Under Title VII of the Civil Rights Act (Guidance) which was originally approved in 2012. The rescission is effective immediately. The rescission does not restore policy statements superseded by the 2012 Guidance, nor does it require employers to abandon any lawful practices they may have adopted in response to it.

"The Commission's rescission of the enforcement guidance reaffirms the agency's commitment to enforce Title VII consistent with the Constitution and the limits Congress placed on the EEOC's authority," said EEOC Chair Andrea Lucas. "Rescinding this guidance does not give employers license to engage in unlawful discrimination - Title VII continues to prohibit discrimination based on race or national origin, including employment requirements that are proxies for intentional discrimination. The EEOC will continue to vigorously enforce these protections in accordance with the law."

The EEOC is the sole federal agency authorized to investigate and litigate against businesses and other private sector employers for violations of federal laws prohibiting employment discrimination. For public sector employers, the EEOC shares jurisdiction with the Department of Justice's Civil Rights Division. The EEOC also is responsible for coordinating the federal government's employment antidiscrimination effort. More information about the EEOC is available at www.eeoc.gov .
