03/25/2026 - Important new guidance for disallowed cases

To further streamline processes for disallowed cases, the New York State Workers' Compensation Board is issuing the following new guidance for payers.

If a case has been disallowed:

  • Do not file a C-8.1B:A Notice of Objection to a Payment of a Bill for Treatment Provided (Form C-8.1B) is no longer required if the case is disallowed. Effective immediately, if a Form C-8.1B is submitted for a disallowed case, parties will be notified that no action will be taken.
  • Do file an EOB/EOR: If the case has been disallowed, payers should instead file an Explanation of Benefits/Explanation of Review (EOB/EOR) to the health care provider.

The CARC/RARC documentation on the Board's website has been updated to reflect this change.
