Mock trial builds understanding of civil litigation process

Civil Nuclear Constabulary (CNC) officers and policing partners have taken part in a realistic mock civil trial designed to strengthen understanding of how the courts assess police decision-making following road traffic collisions.

Delivered by the CNC's Legal Services team in partnership with Strata Solicitors and Farrar's Building Chambers, the exercise recreated civil court proceedings to provide practical insight into how claims for compensation are determined and the evidence that can influence judicial decisions.

The event brought together members of the Operational Driver Training Unit, Health and Safety, Chief Inspectors from sites across England, and representatives from public transport organisations and Royal Mail.

Through the mock trial, delegates saw how documentary, oral and video evidence is presented, scrutinised and challenged in court. The exercise also demonstrated how witness testimony is tested to establish the facts of a case, giving participants a greater understanding of the legal processes that follow serious incidents.

The session explored recent legal developments affecting policing, including the extent of the police's duty to protect others from risks they have not caused or contributed to. Delegates also considered the importance of ensuring officers receive appropriate training and are equipped to make effective dynamic risk assessments in fast-moving operational situations.

The event concluded with a question-and-answer session with the barristers, who provided further insight into emerging legal issues relevant to policing.

The mock trial forms part of the CNC's ongoing commitment to professional development, helping officers and staff build the legal knowledge and confidence needed to support lawful, proportionate and evidence-based decision-making.
