BUFFALO, N.Y.-U.S. Attorney Michael DiGiacomo announced today that Benjamin Martin, 21, of Buffalo, NY, pleaded guilty to transferring a firearm to an out of state resident, which carries a maximum penalty of five years in prison.
Between March 2023, and June 23, 2025, Martin conspired with Hassain Humphrey, Keishawn Turner, Jylin Woods, and Jerry Antonio Baine, to illegally sell firearms. On November 10, 2023, Martin and Humphrey met with an individual at a location in Amherst, NY, in order to sell a handgun for $600. Ultimately, and with assistance from Jylin Woods, the transaction was completed. Martin indicated to the buyer that he would be able to sell him additional firearms. Between November 10 and December 14, 2023, Martin messaged the individual regarding the sale of a "ghost gun," a commonly used term for a privately manufactured handgun without a serial number, and a revolver. Martin and the individual discussed a price for both firearms and coordinated a meeting location. Martin also messaged Humphrey, stating that he had secured a buyer for two firearms, including a "ghost gun." The two also discussed how they would split the profits between themselves and a third unnamed individual. Martin admits neither he, Humphrey, nor the individual were licensed importers, manufacturers, dealers, and collectors of firearms.
Humphrey, Turner and Baine were previously convicted and are awaiting sentencing. Charges remain pending against Jylin Woods.
This case is part of Operation Take Back America, a nationwide initiative that marshals the full resources of the Department of Justice to repel the invasion of illegal immigration, achieve the total elimination of cartels and transnational criminal organizations (TCOs), and protect our communities from the perpetrators of violent crime.
The case is being prosecuted by Assistant U.S. Attorneys Louis A. Testani and Monica Benjovsky. The plea is the result of an investigation by the Buffalo Police Department, under the direction of Police Commissioner Erika Shields and the Bureau of Alcohol, Tobacco, Firearms, and Explosives, under the direction of Special Agent-in-Charge Bryan DiGirolamo.
Sentencing is scheduled for March 4, 2027, before U.S. District Judge Lawrence J. Vilardo.
