City Attorney Wes Duncan Announces Two Domestic Battery Convictions


Domestic Battery Conviction and and Domestic Violence in the Presence of a Child
The Sparks City Attorney's Office announced that its prosecutors convicted Markus Sayles of Domestic Battery, first offense, and Domestic Violence in the Presence of a Child, stemming from an incident that occurred on October 4, 2025.
On October 4, 2025, the reporting party, a fifteen-year-old minor child, called 911 stating that Sayles, her stepfather, was beating her mom, the victim. Upon arrival, Sparks Police Department observed a sixteen-year-old female child anxiously waiting in the parking lot, who then rushed to the apartment to let officers inside.
Officers entered the apartment, found Sayles sitting in the living room, detained him, and were told by Sayles that only a verbal argument had occurred. The victim disclosed to officers that a verbal argument occurred that day and the argument escalated when Sayles got on top of the victim, grabbed her shirt collar, and shook her. The sixteen-year-old minor child intervened and placed Sayles in a headlock and managed to remove Sayles off the victim. Officers reviewed a video recording of the altercation that corroborated the victim's version of events. The officers arrested Sayles and the Sparks City Attorney's Office filed charges.
On November 18, 2025, the Sparks City Attorney's Office secured a conviction for Domestic Battery, first offense, and Domestic Violence in the Presence of a Child, against Sayles.
City Attorney Wes Duncan stated, "Domestic violence in any form, but particularly domestic violence perpetrated in the presence of children, will not be tolerated by our Office."
As a result of the conviction, Sayles was sentenced to 180 days in Washoe County Jail suspended for two years on the Domestic Battery, first offense; on the condition Sayles serve 2 days in the Washoe County Jail, complete forty-eight hours of community service, pay a $200 fine and a $35 domestic violence fee, complete 26 weeks of domestic violence counseling, and obey all laws. Sayles was additionally sentenced to forty-six days of active Washoe County Jail for the Domestic Violence in the Presence of a Child charge, consecutive to the Domestic Battery sentence.

Domestic Battery and Violate Extended Protection Order Against Domestic Violence Conviction
The Sparks City Attorney's Office announced that its prosecutors convicted Nestor Rosales of Domestic Battery, first offense, and Violate Extended Protection Order Against Domestic Violence, first offense, stemming from an incident that occurred on October 24, 2025.

On October 24, 2025, Sparks Police Department responded to a call of a domestic disturbance. Upon arrival, officers contacted two females inside a vehicle: the victim, who was bleeding from her left elbow, and the victim's minor daughter. The victim disclosed to officers she was at Baldini's when she saw Rosales, her ex-boyfriend, inside. The victim took an Uber home and at her apartment, Rosales confronted the victim about ending their relationship several months prior. Rosales hit the victim in the back of the head and pushed the victim to the ground, which caused her to land on her left elbow. Rosales had fled before law enforcement arrived.

The victim's daughter was sleeping inside the apartment during the altercation but stepped outside the balcony when she heard screaming and saw Rosales drive off at a high rate of speed laughing at the victim. Officers learned Rosales had been previously served an extended protection order on May 21, 2025, and court-ordered to have no contact with the victim.

The next day, law enforcement found Rosales and interviewed him. Rosales admitted to pushing the victim but only after the victim pushed and hit him first. Because officers did not observe any visible injuries on Rosales, the officers arrested Rosales and the Sparks City Attorney's Office filed charges against him.

"Our office will continually stand up for victims of domestic violence," said City Attorney Wes Duncan.

On each charge, Rosales was sentenced to 180 days Washoe County Jail suspended for 2 years, with both sets of 180 days running consecutive between each count; on the condition Rosales serve 2 active days in the Washoe County Jail, complete 48 hours of community service, pay a $200 fine and a $35 domestic violence fee, complete 6 months of domestic violence counseling, abstain from the use of controlled substances and/or alcohol, comply with Sparks Municipal Court's compliance program, obey all laws, and have no contact with the victim. Additionally, Rosales was revoked on his prior case for Destruction of Property, involving the same victim, and was sentenced to 45 active days in the Washoe County Jail.
