NOTICE OF PUBLIC HEARING AND FINAL READING FOR REZONING

The City of Palm Bay, Florida, proposes to adopt the following ordinance: 2025-48.

The Palm Bay City Council will hold a public hearing on the ordinance on October 16, 2025, at 6:00 P.M., at City Hall Council Chambers, 120 Malabar Road SE, Palm Bay, Florida.

(Rezoning property, located north of Willowbrook Street, in the vicinity southwest of the intersection of St. Johns Heritage Parkway and Mara Loma Boulevard, from GU (General Use Holding District) and AU (Agricultural Residential) (Brevard County) to RS-3 (Single-Family Residential District))

AN ORDINANCE OF THE CITY OF PALM BAY, BREVARD COUNTY, FLORIDA, AMENDING THE ZONING ORDINANCE OF THE CITY OF PALM BAY BY CHANGING THE ZONING OF PROPERTY FROM GU (GENERAL USE HOLDING DISTRICT) AND AU (AGRICULTURAL RESIDENTIAL) (BREVARD COUNTY) TO RS-3 (SINGLE-FAMILY RESIDENTIAL DISTRICT); WHICH PROPERTY IS LOCATED NORTH OF WILLOWBROOK STREET, IN THE VICINITY SOUTHWEST OF THE INTERSECTION OF ST. JOHNS HERITAGE PARKWAY AND MARA LOMA BOULEVARD, AND LEGALLY DESCRIBED HEREIN; PROVIDING FOR A CHANGE OF THE ZONING MAP; PROVIDING FOR AN EFFECTIVE DATE.

A portion of Lots 16 through 42, and Lots 43 through 47 inclusive, Plot of Cape Kennedy Groves Unit 11, a Subdivision according to the plat thereof as recorded in Plat Book 21,at Page 77, of the Public Records of Brevard County, Florida, and Lots 44, 45, and a portion of Lot 46, Plot Plans of Sunshine Grove, Unit 5, a Subdivision according to the plat thereof, recorded in Plat Book 21, Page 78, Public Records of Brevard County, Florida, all lying in Sections 4 and 9, Township 30S, Range 37E, Brevard County, Florida, and being more particularly described as follows:

Begin at the southeast corner of the west ½ of said Section 4; thence run S 00°19'06" E along the east line of the northwest ¼ of said Section 9 for a distance of 2375.26 feet to the north right of way line of Willowbrook Street (a 120 foot wide right of way) per the Official Records Book 3124, Page 2689, of the Public Records of Brevard County, Florida; thence run N 89°38'36" W along said north right of way line for a distance of 144.22 feet to the east line of Lot 47 of said plot plans of Sunshine Grove Unit 5; thence run N 00°00'40" W along the east lines of Lot 47 and Lot 43 of said plot plans of Sunshine Grove Unit 5 for a distance of 1157.02 feet to the north line of said plot plans of Sunshine Grove Unit 5; thence run S 89°47'59" W along said north line for a distance of 50.86 feet to the east line of Lot 48 of said plot of Cape Kennedy Groves Unit 11; thence run N 00°31'00" W along said east ine for a distance of 654.93 feet; thence run S 89°32'51" W for a distance of 1619.57 feet; thence run N 00°11'59" W for a distance of 639.60 feet to the south line of Parcel B as described in Official Records Book 3480, Page 685, of the Public Records of Brevard County, Florida; thence run N 89°52'38" E along said south line for a distance of 1809.17 feet to the east line of the west ½ of said Section 4; thence run S 00°29'41" E along the east line of the west ½ of said Section 4 a distance of 68.11 feet to the point of beginning; containing 32.97 acres, more or less.

Interested parties may appear at the meeting and be heard with respect to the proposed ordinance(s). The ordinance draft(s) may be inspected by the public from 8:30 A.M. to 5:00 P.M., weekdays, in the Office of the City Clerk, City Hall, 120 Malabar Road, SE, Palm Bay, Florida.

Any aggrieved or adversely affected person desiring to become a party in the quasi-judicial proceeding shall provide written notice to the City Clerk which notice shall, at a minimum, set forth the aggrieved or affected person's name, address, and telephone number, indicate how the aggrieved or affected person qualifies as an aggrieved or affected person and indicate whether the aggrieved or affected person is in favor of or opposed to the requested quasi-judicial action. The required notice must be received by the Clerk no later than five (5) business days at the close of business, which is 5:00 p.m., before the hearing (Section 59.03, Palm Bay Code of Ordinances).

If an individual decides to appeal any decision made by the City Council with respect to any matter considered at this meeting, a record of the proceedings will be required and the individual will need to ensure that a verbatim transcript of the proceedings is made, which record includes the testimony and evidence upon which the appeal is based (Section 286.0105, Florida Statutes). Such person must provide a method for recording the proceedings verbatim.
