Meazure Learning Documents Prompt State Bar to Amend Lawsuit Against February 2025 Bar Exam Administration Vendor

The State Bar of California filed an amended complaint Wednesday against ProctorU, dba Meazure Learning (Meazure Learning), the vendor it contracted with to facilitate the remote and in-person administration of the February 2025 California Bar Exam, the Office of General Counsel announced today. As was extensively reported, test takers experienced widespread problems with Meazure Learning's administration of the exam. The State Bar amended its original complaint after receiving, as part of the discovery process, Meazure Learning's internal documents showing that the vendor was making false promises it knew it was unable to deliver on.

The amended complaint begins: "As revealed by the documents that Meazure has finally produced, Meazure sold competence but delivered chaos."

"Meazure Learning promised the State Bar that it could deliver a seamless exam experience, all while knowing it was not up to the job," said State Bar Board of Trustees Chair José Cisneros. "By this amended complaint, the State Bar advances its efforts to hold them accountable."

The amended complaint has dozens of references to Meazure Learning's own internal communications that substantiate the State Bar's original allegations. As the amended complaint details, "even as Meazure externally pitched its ability to handle the California Bar Exam's unique volume and demands, Meazure internally" questioned its ability to do so. (See amended complaint, paragraph 4.) The amended complaint also depicts numerous other instances of wrongdoing. For example, Meazure Learning deliberately hid information from the State Bar despite the State Bar's requests for additional information to determine what went wrong following a problematic bar examination study and mock exam. "Meazure's deception and delay tactics did not just violate the parties' contracts. They concealed the true nature and extent of the issues," which Meazure Learning was apparently unable to address. "Now that we have finally received some of Meazure Learning's internal documents, we see that they strengthen and support the State Bar's original claims," said General Counsel Ellin Davtyan. "Meazure knew it was woefully unprepared to administer this exam but gave the State Bar assurances to the contrary."

The lawsuit, originally filed in Los Angeles Superior Court on May 5, 2025, includes claims for fraud, negligent misrepresentation, and breach of contract, and seeks both compensatory and punitive damages. The redacted portions of the amended complaint reflect communications that Meazure Learning has deemed "confidential," which means that the State Bar is not yet permitted to make those documents public. The State Bar intends to challenge Meazure Learning's efforts to keep these communications out of the public eye.
