Partner Christina Moser and Associate Melissa Bilancini successfully defended Alexy Metals, a brazing alloys and precious metals refining company, in a trademark infringement lawsuit related to the client's shield-shaped design mark. The Cuyahoga County Court of Common Pleas granted Alexy Metals summary judgment, finding all factors in the likelihood of confusion analysis weighed in the client's favor.
Upon losing the county case, the plaintiff then filed a copyright infringement lawsuit in the U.S. District Court for the Northern District of Ohio. On July 6, 2026, the federal court dismissed the lawsuit with prejudice due to the lack of similarity; the following day, the state court granted Alexy Metals' motion for attorneys' fees in full, awarding the client $307,000. The court also found the plaintiff's claims frivolous and its pursuit of those claims despite receiving notice of their lack of merit rendered the case exceptional under the Lanham Act.
