ORDER NO. 7 (COMMISSION) Accordingly, based upon the totality of the evidence presented in this Docket, the Commission finds that the Settlement Agreement, as clarified and modified herein, is just and reasonable and in the public interest. As such, the Commission directs and orders as follows: 1. The Settlement Agreement is approved as clarified and modified by the Commission in this Order. 2. The parties shall inform the Commission by a filing no later than noon on December 12, 2016, whether they accept the Commission's proposed modification of the Settlement Agreement or request a full hearing on the issues. 3. ORDER NO. 10 (COMMISSION) The Commission finds that the additional information proposed to be filed by EAI to address the 2016 Rider FRP settlement items is reasonable and should enable the parties and the Commission to more thoroughly review the specified items. The Commission therefore approves the Settling Parties' proposal. The Commission also approves the Settling Parties' proposal to file testimony addressing the nuclear costs on a concurrent schedule with the 2017 FRP Evaluation Report. However, the Commission notes that based on the testimony filed and issues raised, the consideration of these nuclear costs may necessarily go beyond the schedule set for the 2017 Evaluation Report. A determination of whether these nuclear costs will be considered in the hearing for the 2017 Evaluation Report or a separate hearing will be made at a later time. Ks
