America's Essential Hospitals is closely monitoring the executive orders signed by President Trump since he took office on Jan. 20, as well as related lawsuits challenging the executive orders and other agency actions. The association will continue to provide biweekly lawsuit updates and real-time summaries of executive orders and related agency actions.
Since the association's last update on Dec. 23, the First Circuit Court of Appeals upheld a lower court's decision to stop the National Institutes of Health (NIH) from implementing a new 15% cap on indirect costs.
The D.C. federal district court held that the president's proclamation raising the application fee for employees filing new H-1B visa petitions is lawful. The Chamber of Commerce filed an appeal of the lower court's decision in the D.C. Circuit Court of Appeals.
A California district court partially lifted its preliminary injunction in the lawsuit challenging the sharing of Medicaid data for immigration enforcement purposes. The Department of Health and Human Services (HHS) now may share the basic biographical, location, and contact information of Medicaid recipients in the suing states with the Department of Homeland Security.
HHS issued a declaration defining "sex-rejecting procedures," also known as gender transition care, stating that such procedures for minors are neither safe nor effective, and warning that providers could be excluded from Medicare and Medicaid for administering such care. Nineteen states and Washington, D.C. filed a lawsuit challenging HHS' authority to issue the declaration.
