Administration Update: Birthright Citizenship Upheld; H-1B Visa Fee Struck Down

America's Essential Hospitals is closely monitoring President Trump's executive orders, as well as related lawsuits challenging the executive orders and other agency actions. The association will continue to provide monthly lawsuit updates and real-time summaries of executive orders and related agency actions.

Since the association's last update on June 9, the Supreme Court struck down the president's executive order ending birthright citizenship and upheld the longtime definition of birthright citizenship.

Additionally, a federal district court in Massachusetts vacated the $100,000 application fee for employers filing new H-1B visa petitions; the decision has a nationwide effect. However, the fee has been temporarily reinstated while the First Circuit Court of Appeals considers the government's request for a stay of the district court's decision while an appeal is pending.

Members can access the association's latest review of the lawsuits against the Trump administration's actions and a full summary of executive orders from Jan. 20 through Aug. 19, 2025.
