BSF Advises Atomic Eagle in Settlement Negotiations Regarding Niger Uranium Dispute

Atomic Eagle has announced that it is set to sign a new agreement with the Republic of Niger restoring its interest in the Madaouela uranium project, paving the way for the discontinuation of an ICSID arbitration commenced by its predecessor, GoviEx Uranium.

Boies Schiller Flexner advised Atomic Eagle in the settlement negotiations, led by partner Timothy Foden and associate Othmane Benlafkih. The agreement establishes a new framework for the project's development, including internationally recognized dispute resolution mechanisms and a joint ownership structure between Atomic Eagle and the Nigerien state.

The resolution highlights the important role that investment treaty and international arbitration proceedings can play in creating a pathway to negotiated outcomes between investors and states. It also reflects a broader trend of governments and foreign investors seeking commercially viable solutions to disputes arising from changes in regulatory and political environments, particularly in strategically important sectors such as mining and natural resources. For businesses operating in emerging markets, the development underscores the value of preserving legal protections and maintaining constructive engagement with host states when disputes arise over investments and resource projects.
