Attorney General Kathy Jennings released the following statement in response to the Delaware House of Representatives' failure to pass SB 100:
"For years now, Delaware's General Assembly has repeatedly moved the needle forward on LGBTQ+ rights and civil rights writ large; in recent years that movement has been unflinching. That record makes it all the more shocking and upsetting that the Delaware House of Representatives failed to advance a basic, core tenant of equality-cementing in our constitution the right to same-sex and interracial marriage and guaranteeing those rights regardless of political majority or the U.S. Supreme Court's rulings. We have been taught more than once that policy once considered "settled law" is anything but, and we must operate under that paradigm.
Failing to permanently enshrine those protections in our state's Constitution is an appalling abdication of the state government's duty to guarantee the rights of every Delawarean. It adds insult to injury that this vote was cast in the closing days of Pride Month.
This constitutional amendment can yet be revived and brought up for a new vote, and I join Delawareans across the state in urging members to reconsider their votes. We can and must guarantee, now, while we can, that this right is enshrined in the Constitution in perpetuity."
