Albany County District Attorney Lee C. Kindlon announced today that new charges have been filed against two men allegedly involved in a May 2023 drive-by shooting that killed a man and injured two others, while a fourth suspect has been identified and formally charged in connection to the murder.

Samir Princeton, 21, of Albany, and Dejoune Smith, 20, of Troy, were arraigned Friday on a superseding indictment in front of the Honorable William Little that adds Conspiracy in the First Degree to the original charges of Murder in the Second Degree, two counts of Attempted Murder in the Second Degree, Criminal Possession of a Weapon in the Second Degree, and Conspiracy in the Second Degree.

A fourth suspect who is 18 years old now but 15 at the time of the shooting was arraigned on a sealed grand jury indictment Thursday in Albany County Court that charges him with Murder in the Second Degree, two counts of Attempted Murder in the Second Degree, Criminal Possession of a Weapon in the Second Degree, and Conspiracy in the Second Degree.

All three pleaded not guilty and were remanded.

Timmoure Miller, another co-defendant in the shooting case, was sentenced in November to serve 25 years in state prison after pleading guilty to Manslaughter in the First Degree.

Albany Police alleged that the four males who are members of an uptown gang drove to Village Barber and Beauty on Second Avenue on May 13, 2023 and opened fire with multiple handguns, killing barber Tyrone Staley, 47, and wounding a 19-year-old man and a 9-year-old boy. Police believe the 19-year-old was the intended target.

The trial against Princeton and Smith was slated to start Monday but new evidence allegedly linking the 18-year-old to the shooting was recently discovered. A new trial date has yet to be set.

Princeton was also sentenced Tuesday to serve 15 years in prison for two arrests last year involving a large quantity of narcotics and an illegal handgun.

Assistant District Attorney and Major Crimes Bureau Chief Joseph Brucato is prosecuting the case.
