Parliament, Saturday, 8 August 2026 - The Speaker of the National Assembly, Ms Thoko Didiza, has received and noted a communication from the Secretary-General of the African National Congress (ANC), Mr Fikile Mbalula, concerning the recommendation of an Evidence Leader for the Section 89 Impeachment Committee.
In its communication, the ANC disclosed that Adv T G Madonsela SC, whom the committee resolved to recommend as Evidence Leader, had previously been briefed to provide legal advice to the ANC on matters relating to the Section 89 parliamentary rules and processes. The ANC states that the disclosure does not constitute an objection to the committee's decision, nor does it question the integrity or independence of Adv Madonsela SC, but is intended to place the information formally on record before the process is concluded.
The matters raised relate directly to the deliberations and decisions of the committee and therefore properly fall within the committee's processes. Accordingly, the Speaker has referred the communication to the Chairperson of the committee for consideration by the committee.
The committee had determined that it would, through its own processes, select an Evidence Leader to assist it in its work. Once the committee has concluded its decision-making process, the parliamentary administration will facilitate the necessary procurement and administrative processes.
It is therefore appropriate that any matter bearing on the committee's decision regarding the Evidence Leader be considered by the committee itself, without the Speaker pre-empting or pronouncing on matters falling within its mandate.
