Warren Statement on Bipartisan Housing Bill Becoming Law Without Trump Signature

Washington, D.C. - U.S. Senator Elizabeth Warren (D-Mass.), Ranking Member of the Senate Banking, Housing, and Urban Affairs Committee, released the following statement on the 21st Century ROAD to Housing Act's automatically becoming law under the U.S. Constitution after President Trump failed to sign it for 10 days:

"At the stroke of midnight, a huge bipartisan bill to lower housing costs became law without the President's signature. Why did President Trump sit on the landmark housing bill for more than 2 weeks? Maybe because there was nothing in it for him personally-no gold-encrusted ballroom, no Qatari jet, no $2 billion crypto deal. Nothing in the 21st Century ROAD to Housing except ways to make housing more affordable. Donald Trump couldn't pick up the pen because he just isn't interested in lowering costs for American families.

"This is the biggest housing legislation in more than 30 years, and the biggest affordability win for the American people in this Congress. It will build more housing, bring down costs, and stop private equity from buying up single-family homes for the first time ever. Our country's housing crisis demands more action, and Democrats are ready to do more to address America's affordability crisis."

Here's an explanation on the bill becoming law tonight, on background from a Banking Committee aide:

  • The Constitution is clear: "If any Bill shall not be returned by the President within ten Days (Sundays excepted) after it shall have been presented to him, the Same shall be a Law, in like Manner as if he had signed it, unless the Congress by their Adjournment prevent its Return, in which Case it shall not be a Law."
  • After passing the Senate and the House with huge bipartisan majorities, the 21st Century ROAD to Housing Act was presented to the President on Monday, June 29th. Ten days later, excluding Sundays, is 11:59pm on Friday, July 10 / 12:00am on Saturday, July 11.
  • The second session of the 119th Congress began on January 3, 2026, and Congress has not adjourned for the session.
  • So when the bill fails to return to Congress within ten days, it automatically becomes law.
