PUBLIC NOTICE OF APPLICATION FOR WATER RIGHTS LAS 27268

Pursuant to Alaska Statue (AS) 46.15 and rules and regulations (11 Alaska Administrative Code [AAC] 93) promulgated thereunder, public notice is hereby given that an Application for Water Rights for water withdrawals from a drilled well have been received from Dart-AM, LLC, PO Box 57007, North Pole, AK, 99705. The application was reviewed for accuracy and completeness. A case file for these requested water uses has been created.

Assigned Case File and Priority Date of Application for Water Rights:

Application LAS 27268 has a priority date of May 12, 2009.

Legal Description of Requested Water Source and Area of Appurtenance:

The LAS 27268 water rights application is for 2,000 gallons per day year-round for four single-family residences and 3.78 Acre-Feet per Year for commercial irrigation and greenhouse heating uses February 1st through November 31st from a drilled well, approximately 120 feet in depth.

The well is located within the Southwest One-Quarter of the Southwest One-Quarter (SW1/4SW1/4) Section 9, Township 2 North, Range 15 West, Fairbanks Meridian within below-described Lot 4. The area of appurtenance is Lot 4, Dart Subdivision, First Addition according to Plat No. 2007-6 filed in the Manley Recording District. Said lot is located within the Southwest One-Quarter of the Southwest One-Quarter (SW1/4SW1/4) Section 9 and the Northwest One-Quarter of the Northwest One-Quarter (NW1/4NW1/4) Section 16, Township 2 North, Range 15 West, Fairbanks Meridian.

Per AS 46.15.133 (a), within 15 days of publication or service of notice, persons may file with the director written objections, stating the name and address of the objector, and any facts tending to show that rights of the objector or the public interest would be adversely affected by the proposed sale, appropriation, or removal.

The Water Resources Section must receive comments in writing by 5:00 p.m., October 1, 2025 at the above addresses to be considered. If issued, a permit may be extended for good cause shown, pursuant to AS 46.15.110 and 11 AAC 93.120(f), without additional public notice.
