Form I-9 Expiration Date: What Employers Need to Know Before August 1, 2026

Employers should review the version of Form I-9, Employment Eligibility Verification, they currently use. One accepted version of Form I-9 expires on July 31, 2026, and should no longer be used after that date.

Form I-9 is required to verify the identity and employment authorization of employees hired to work in the United States.

Which Form I-9 Is Expiring?

Employers may currently encounter several acceptable versions of Form I-9.

The Form I-9 with an edition date of August 1, 2023, may display one of two expiration dates:

  • July 31, 2026
  • May 31, 2027

The version displaying the July 31, 2026 expiration date may be used through that date. Beginning August 1, 2026, employers should use a Form I-9 displaying the May 31, 2027 expiration date.

The latest revised Form I-9 has an edition date of January 20, 2025, and an expiration date of May 31, 2027. USCIS also continues to accept the August 1, 2023 edition that displays the May 31, 2027 expiration date.

How to Check Your Form I-9 Version

Employers can identify the version of Form I-9 by checking two locations:

  • The edition date appears in the lower-left corner of the form.
  • The expiration date appears in the upper-right corner.

Employers should review paper forms, onboarding packets, shared files and electronic hiring systems to determine whether outdated versions remain in use.

What Employers Should Do Before August 1, 2026

Employers should:

  • Identify any Form I-9 displaying a July 31, 2026 expiration date.
  • Remove that version from onboarding materials and hiring systems before August 1, 2026.
  • Replace it with an acceptable version displaying the May 31, 2027 expiration date.
  • Confirm that employees responsible for onboarding and employment verification know which form to use.
  • Review links, templates and saved copies that may contain an older version.

The current Form I-9 and its instructions are available through the U.S. Citizenship and Immigration Services website.

Do Employers Need to Complete New Forms for Current Employees?

Employers generally do not need to complete a new Form I-9 for a current employee solely because the form used at the time of hire has since expired.

A properly completed Form I-9 remains valid even after that version's expiration date. Employers should use the current acceptable version when completing a new Form I-9 or when a new form is otherwise required.

Employers should review their Form I-9 procedures now and replace any versions displaying the July 31, 2026 expiration date before using the form for new hires after that date.
