Joint Statement - Commission decision against Alphabet under Article 6(5) DMA - Google Search

CER joins a broad coalition of industry stakeholders representing the rail, airline and hospitality sectors in a joint statement following the adoption by the European Commission of its decision against Alphabet for non-compliance with Article 6(5) of the Digital Markets Act (DMA) in the Google Search case, opened more than two years ago.

The decision confirms Alphabet's failure to comply with its obligations under Article 6(5) of the Digital Markets Act, bringing legal clarity, after several years of intensive engagement, investigations and technical discussions.

This is an important milestone for the credibility of the DMA and for fair digital markets in Europe, however a central question remains over how compliance should work in practice and avoid structurally favouring online intermediaries over direct suppliers' offers.

For the coalition, effective implementation must

  • Preserve price transparency and accurate consumer information;
  • Ensure fair and non-discriminatory visibility for all market participants, including direct suppliers;
  • Support open, competitive digital ecosystems that foster innovation and investment in Europe.
