Overtime Threshold Decreases to 52 Hours on January 1

The New York State Department of Labor (NYSDOL) announced today that the threshold for overtime pay for farmworkers will be reduced January 1, 2026. The new, lower threshold will be 52 hours per week. The overtime threshold limit will continue to decrease by four hours every other year until it reaches 40 hours per week in 2032. This schedule was established in Labor Commissioner Roberta Reardon's 2023 order, which accepted the report and recommendations of the Farm Laborers Wage Board.

"Agriculture is essential to families statewide and a vital part of New York's economy," said New York State Department of Labor Commissioner Roberta Reardon. "Our continued implementation of this transition ensures that farmers can steadily adjust to these phased changes while enabling farm workers to better support themselves and their families."
