The EFTA Surveillance Authority (ESA) has accepted binding commitments offered by Dixon Stores Group Retail Norway AS, Elkjøp Nordic AS and Elkjøp Norge AS (together, Elkjøp) to address ESA's preliminary concerns regarding possible infringements of EEA competition rules in the retail sale of electronic goods in Norway.
ESA opened its investigation following an unannounced inspection in 2021. In a preliminary assessment issued in June 2025, ESA indicated that Elkjøp may have held a dominant position in one or more of the consumer electronic markets in Norway, and may have abused that position under Article 54 of the European Economic Area Agreement by incentivising suppliers to limit supplies to certain competitors.
While Elkjøp does not agree with ESA's preliminary findings, it offered commitments in September 2025 to address the concerns. Elkjøp commits not to enter into, request or incentivise agreements with suppliers that restrict or disadvantage distribution to specific competitors in Norway. It also commits to annual notifications to suppliers, annual competition compliance training, and monitoring and reporting measures.
The commitments will apply for five years, with the possibility of being extended for up to five additional years.
ESA considers the commitments sufficient to address its concerns. A market test confirmed their appropriateness, and ESA has therefore made them legally binding on Elkjøp.
Commenting on the decision, ESA Vice President Árni Páll Árnason said: "By accepting binding commitments, ESA has been able to address its preliminary concerns and ensure effective competition in an important sector for Norwegian consumers."
The decision does not conclude whether an infringement has occurred. It entirely closes the proceedings initiated by decision of May 2023.
